Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Mim and Krystallos web and mobile applications (collectively, the "Service") operated by Kaleidoscope Axiom Inc. ("we," "us," "our"), a Canadian corporation based in Ontario.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

Description of Service

Krystallos (Web Application)

Krystallos is a free web-based personal values assessment tool that helps you:

  • Rate and organize your personal values
  • Build a visual representation (Humanistic Tree) of your value system
  • Explore the relationships between your values

Key Features:

  • No account required
  • Assessment data stored locally on your device (in browser local storage)
  • Optional email subscription for updates about Krystallos and Mim
  • Optional analytics and survey participation (requires consent)

Mim (Mobile Application)

Mim is a subscription-based mobile coaching application that includes:

  • Complete personal values assessment
  • AI-powered life coaching aligned with your values
  • Cloud-synced conversation history and progress
  • Journey-specific coaching (Career, Health, Relationships, Personal Growth)

Use of Artificial Intelligence

The Mim Mobile App incorporates Artificial Intelligence technology to provide personalized insights and coaching.

The Service, including any AI-generated content, is not a substitute for:

  • Medical advice, diagnosis, or treatment
  • Psychological or psychiatric care
  • Professional counseling or therapy
  • Financial, legal, or other professional advice

If you are experiencing a mental health crisis, suicidal thoughts, or any medical emergency, please contact emergency services immediately or seek help from a qualified healthcare professional.

By using the Service, you acknowledge that:

  • AI responses are generated by algorithms and may not always be accurate, complete, or suitable for your specific situation
  • You are responsible for evaluating the appropriateness of any suggestions or insights provided
  • We are not liable for decisions you make based on AI-generated content

User Accounts and Responsibilities

Krystallos (Web Application)

  • No account creation required
  • You are responsible for your device security and browser data
  • Assessment progress is stored in your browser's local storage
  • Clearing your browser data will delete your assessment progress
  • Optional: You may provide your email address for updates (requires marketing consent)

Mim (Mobile Application)

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Using a secure password and protecting it from disclosure

We reserve the right to suspend or terminate accounts that violate these Terms.

Consent and Data Collection

Explicit Consent Required: We require your explicit consent for:

  1. Analytics tracking — Understanding how you use the Service to improve it (PostHog)
  2. Marketing communications — Collecting your email address to send updates about Krystallos and Mim

What You Consent To:

  • When you accept analytics consent, we may track your usage patterns, session data, and interactions within the Service using PostHog analytics (data processed in the United States)
  • When you accept marketing consent, we may collect your email address and send periodic updates about our services
  • You may withdraw consent at any time via the "Privacy Settings" link in the application

Essential Storage (No Consent Required):

  • Krystallos stores your assessment progress locally on your device using browser local storage
  • This is essential for the application to function and does not require consent
  • No data leaves your device unless you explicitly sync with Mim or provide your email

Intellectual Property Rights

Our Content

All content provided through the Service, including but not limited to:

  • Software, code, and algorithms
  • Assessment methodology and value word lists
  • AI coaching prompts and responses
  • Design, graphics, and user interface
  • Documentation and help materials

is owned by Kaleidoscope Axiom Inc. or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, distribute, or create derivative works from our content
  • Reverse engineer, decompile, or disassemble the software
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use our content for commercial purposes without written permission

Your Content

You retain ownership of the content you create through the Service, including:

  • Your value assessment responses
  • Your coaching conversation history (Mim)
  • Feedback and survey responses you provide

By using the Service, you grant us a limited license to use your content solely to:

  • Provide and improve the Service
  • Generate AI coaching responses (Mim)
  • Analyze usage patterns (with your analytics consent)

We will not sell or share your personal content with third parties except as described in our Privacy Policy.

Subscription Terms (Mim Only)

Fees and Billing

  • Mim is a subscription-based service
  • Subscriptions are managed through your device's app store (Apple App Store, Google Play Store)
  • Billing is handled by the respective app store according to their terms
  • We do not have access to your payment information

Cancellation and Refunds

  • You may cancel your subscription at any time through your app store account settings
  • Cancellation will take effect at the end of your current billing period
  • Refund requests are subject to the app store's refund policy
  • No partial refunds for unused portions of a subscription period

Changes to Pricing

  • We reserve the right to change subscription pricing with 30 days' notice
  • Price changes will not affect your current subscription period
  • Continued use after a price change constitutes acceptance of the new price

Prohibited Uses

You agree not to:

  1. Violate Laws or Rights

    • Use the Service for any unlawful purpose
    • Violate any applicable laws, regulations, or third-party rights

  2. Interfere with the Service

    • Attempt to gain unauthorized access to our systems
    • Introduce viruses, malware, or harmful code
    • Overload, crash, or impair the Service's functionality

  3. Misuse Content

    • Scrape, data mine, or extract data using automated tools
    • Use the Service to develop competing products or services
    • Share your Mim account credentials with others

  4. Abuse AI Features

    • Use AI coaching to generate harmful, illegal, or abusive content
    • Attempt to manipulate or exploit AI responses
    • Rely on AI for emergency situations or critical decisions

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Fitness for a particular purpose — The Service may not meet your specific needs
  • Accuracy — AI-generated content may contain errors or inaccuracies
  • Availability — We do not guarantee uninterrupted or error-free access
  • Security — While we implement security measures, no system is completely secure
  • Outcomes — We do not guarantee any specific results from using the Service

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KALEIDOSCOPE AXIOM INC. SHALL NOT BE LIABLE FOR:

  1. Indirect Damages — Including lost profits, data loss, or business interruption
  2. AI-Related Decisions — Any decisions you make based on AI-generated content
  3. Third-Party Services — Issues caused by app stores, payment processors, or analytics providers
  4. User Content — Consequences of your assessment responses or coaching conversations
  5. Technical Issues — Service outages, bugs, or data loss

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY (OR $100 CAD IF YOU HAVE NOT MADE ANY PAYMENTS).

Indemnification

You agree to indemnify and hold harmless Kaleidoscope Axiom Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit through the Service

Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you also agree to our Privacy Policy.

  • Analytics and marketing require explicit consent

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms with a new "Last Updated" date
  • Displaying a notice in the application
  • Sending an email (if you have provided your email address)

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, please stop using the Service.

Termination

By You

  • Krystallos: You may stop using the web application at any time. Clear your browser data to remove all stored information.
  • Mim: You may cancel your subscription through your app store and delete your account through the app settings.

By Us

We may suspend or terminate your access to the Service:

  • For violation of these Terms
  • For fraudulent or illegal activity
  • If required by law
  • At our sole discretion with or without notice

Upon termination:

  • Your right to use the Service ceases immediately
  • Your Mim account data may be deleted after a grace period
  • Krystallos data stored locally on your device remains until you clear it

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

  1. Informal Resolution: Contact us at info@kaleidoscopeaxiom.com to attempt to resolve the issue informally
  2. Mediation: If informal resolution fails, we agree to participate in good-faith mediation
  3. Arbitration or Court: If mediation fails, disputes may be resolved through binding arbitration or Ontario courts

Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or class-wide arbitration.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kaleidoscope Axiom Inc. regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your rights under them. We may assign these Terms to any successor or affiliate without your consent.

Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, war, government action).
